"What is an Executive Order?
The Michigan Constitution of 1963 vests the executive power of the state in the Governor. That power can be exercised formally by executive order. Executive orders may reorganize agencies within the executive branch of state government, reassign functions among executive branch agencies, create temporary agencies, establish an advisory body, commission, or task force, proclaim or end an emergency, or reduce expenditures authorized by appropriations. Once signed by the Governor, executive orders are filed with the Secretary of State, where the orders are sealed and retained by the Office of the Great Seal." Executive Directive 2020-2 - To order state public bodies to postpone the public meetings and facilitate
remote participation in the meetings that do occur. Later revised under EO 2020-15
Executive Directive 2020-3 - Directed at State Department Directors and Autonomous Agency Heads, Gov. Whitmer ordered the restriction of discretionary spending and the continued implementation of cost containment strategies.
Executive Directive 2020-4 - Governor Whitmer directed the temporary suspension of hiring, creating new positions, filling vacant positions, transfers, and promotions within the executive branch of the state government.
Executive Order 2020-4 –Declaration of a State of Emergency across the State of Michigan. This order maximizes all state efforts to coordinate assistance to local governments and officials so that all available resources are utilized.
Executive Order 2020-5 - Prohibited all gatherings larger than 250 people, except for assemblages for necessary purposes such as the purchase of groceries or consumer goods. This was rescinded by EO 2020-21
Executive Order 2020-6 - To impose temporary restrictions on entry into health care facilities, residential care facilities, congregate care facilities, and juvenile justice facilities. This was rescinded by EO 2020-7
Executive Order 2020-7 - To revise EO 2020-6 so as to permit certain family members or legal guardians’ access to see those under 21 at certain health care facilities, residential care facilities, congregate care facilities, and juvenile justice facilities. No longer effective.
Executive Order 2020-8 - Imposes enhanced restrictions on price gouging. This order is rescinded and
replaced by EO 2020-18. No longer effective.
Executive Order 2020-9 - Effective immediately the executive ordered the closure of specific places of “Public Accommodation” and all places of “Public Amusement” that aren’t specifically listed. The executive order specifically lists bars, restaurants, performance venues, libraries, museums, fitness centers, casinos, and places of public amusement. This order is rescinded and
replaced by EO 2020-11. No longer effective.
Executive Order 2020-10 - Effective Immediately and until April 14, 2020, at 11:59 pm, the executive
order suspends some of the unemployment insurance benefits eligibility requirements for individuals
impacted by COVID-19. Additionally, the employer will not be charged for unemployment benefits when
the employer is forced to close under another executive order (EO 2020-9 or any future EO). This order was rescinded and replaced by EO 2020-24. No longer effective.
Executive Order 2020-11 - Effective March 17th at 9:00 am and until April 5, 2020, at 5:00 pm, the
executive order prohibits indoor assemblies of more than 50 people and events over 50 people. The EO
provides exemptions from the prohibition for the legislature, workplaces not open to the public,
construction workplaces, agricultural workplaces, daycare centers, residential housing on campuses, and
facilities that are exempt under EO 2020-9 (Grocery stores, health care facilities, and crisis centers).
Lastly, the order states that places of religious worship are not subject to a penalty if they violate the 50-
person limit. No longer effective.
Executive Order 2020-12 - Effective immediately until April 13, 2020 at 11:59pm, all state and local
seasonal load restrictions as well as noise and timing restrictions are suspended for deliveries that meet
immediate needs for COVID-19 relief efforts. This order was rescinded and replaced by EO-44. No longer effective.
Executive Order 2020-13 - Effective immediately and continuing through April 14, 2020, at 11:59 pm,
MDHHS and LARA are authorized to waive requirements for Certificate of Need and reduce requirements for licensure and care provision. These provisions aim to ensure that medical facilities are open or allowed to expand as needed and that medical workers are not restricted from providing care due to failure to meet the technical requirements of their license. This order is rescinded by EO 49.
Executive Order 2020-14 – Effective immediately the executive order has extended the redemption
period for abandoned and tax-delinquent property from March 31, 2020, to May 29, 2020, or 30 days
after the end of the state of emergency under EO 2020-4.
Executive Order 2020-15 - effective immediately and through April 15, 2020 the executive order provides temporary authorization for remote participation in public meetings and hearings and temporary relief from required monthly school board meetings. Additionally, the EO supersedes parts of ED 2020-02. This order is rescinded by EO 2020-48
Executive Order 2020-16 – Effective immediately until April 15, 2020 at 11:59pm, the executive order
provides temporary and limited relief from certain regulatory restrictions regarding child care services,
and facilitates the use of certain property for those services to expand child care access during the
COVID-19 emergency. Specifically, the order expedites provisional licensing of child care facilities, and
allows schools and employers to provide unlicensed emergency child care services provided that they
follow rules and guidance set by LARA. This order is rescinded by EO 2020-51.
Executive Order 2020-17 - On Friday, March 20, 2020, Governor Whitmer declared Executive Order
2020-17 to limit non-essential medical and dental procedures. Cosmetic and elective surgeries therefore must be postponed, while essential or emergency trauma-related surgeries will proceed.
Executive Order 2020-18 - Is a rescission and revision of EO 2020-8 which also dealt with price gouging. It puts restrictions in place as it relates to the excessive pricing of goods, materials, emergency supplies, and consumer food items. These restrictions are in place from 9:00 am March 16, 2020 until April 17, 2020 (the original EO was in effect until April 13) at 11:59 pm. This order is rescinded by EO 53.
Executive Order 2020-19 – Effective immediately and until April 17, 2020, at 11:59 pm the executive
order suspends foreclosure and eviction proceedings under the Revised Judicature Act. This order is rescinded by EO 54.
Executive Order 2020-20 – Effective immediately the executive order expands the list of places of public accommodation in Executive Order 2020-9 to include hair studios, nail salons, massage studios, and other non-essential personal care facilities. This order was rescinded and replaced by 2020-43.
Executive Order 2020-21 - The purpose of the order is to temporarily suspend activities that are not
necessary to sustain or protect life. The Executive Order requires all Michigan citizens to stay at home,
unless for life-sustaining activities, and prohibits the following: All in-person work not necessary to sustain or protect life Public or private gatherings (private gatherings are considered those that including individuals that do not reside within the same household) Business or operations that require workers to leave their home or place of residence. This order is rescinded by EO 42.
Executive Order 2020-22 - For the recent March 10th election, the county board of canvassers deadline
was March 24th and the board of state canvassers’ deadline would be March 30th. The executive order
extends these dates one month to April 24th and April 30th respectively. The order is retroactive to
yesterday, March 24th.
Executive Order 2020-23 - Authorizes remote means for carrying out state administrative procedures for
the Michigan Employment Relations Commission (MERC), the Unemployment Insurance Agency (UIA),
and hearings held under the Administrative Procedures Act of 1969. The order is in effect until April 13,
2020 at 11:59pm. This order was rescinded and replaced by EO-45.
Executive Order 2020-24- This order reaffirms the need to temporarily suspend rules and procedure to expand eligibility for unemployment benefits and cost-sharing with employers. EO 2020-24 further expands who may apply for unemployment, and rescinded EO 2020-10 to be effective retroactively to March 16th, 2020 and is set for now to expire on April 22nd, 2020. This order is rescinded by EO 57.
Executive Order 2020-25 – Pharmacists; Effective immediately and through April 22 at 11:59 p.m., EO
25 provides for a variety of efficiencies for Pharmacists and Pharmacies, and includes provisions for
health insurers and drug wholesalers. This order is rescinded by EO 56.
Executive Order 2020-26 - Tax Filing Deadline Extension; Governor Whitmer issued Executive Order
(EO) 2020-26 effective immediately, which extends the deadline for filing and paying state and city
income tax from April 15, 2020 to July 15, 2020. This aligns with the extension for federal income tax
filings and payments.
Executive Order 2020-27 – May 5th Election; the order calls for the May 5th election to be conducted by absent voter (AV) ballots to the greatest extent possible. However, each jurisdiction must maintain at
least one location on Election Day where electors may vote in person if they so choose. Clerks are to
begin preparing postage prepaid AV return envelopes.
Executive Order 2020-28- Restoring water service to occupied residences during the COVID-19 Pandemic; Governor Whitmer ordered the restoration of water services to any occupied residence that had been shut-off due to non-payment. Furthermore, all public water supplied that have used water shut-offs as a remedy for non-payment in the past year must send a detailed report to the State Emergency Operations Center regarding their service area. This order does not reduce or eliminate the obligation of a resident to pay for water, or restrict the ability of a public water supply to charge a customer for water service.
Executive Order 2020-29- Enacts temporary COVID-19 protocols for entry into the Michigan Department of Corrections Facilities as well as transfers to and from Department Custody. EO-29 also encourages the early release of certain populations, provided they do not pose a public safety risk. This order is in effect until April 26, 2020. This order is rescinded by EO 62.
Executive Order 2020-30- Provides the temporary relief from select restrictions and requirements on the provision of medical services. Within designated health care facilities, provisions related to the scope of practice, supervision, and delegation are suspended in whole or part to allow licensed, registered, or certified health care professionals employed within that facility to support the response to the COVID-19 pandemic. This order is rescinded by EO 61.
Executive Order 2020-31- To reduce the impact of the COVID-19 pandemic, it is crucial the supplies needed to mitigate the crisis remain adequately available. As a result of the changed behavior of the state, there is an excess of winter-blend gasoline that typically could not be sold after April 1st under standard vapor pressure requirements. EO 2020-31 temporarily extends this deadline to May 31st of 2020.
Executive Order 2020-32- Beginning no later than March 31st, 2020 and continuing while the declared emergency is in effect, all veterinary facilities must implement a plan to temporarily postpone all in-person non-essential veterinary services, and make every effort to provide services through telemedicine. Non-essential services necessary to preserve the life of a pet, treat serious pain, to euthanize a pet, and other services will still be available. This was rescinded by EO 2020-34
Executive Order 2020-33 - Governor Whitmer issued Executive Order (EO) 2020-33 declare a state of emergency and the state of disaster across the state of Michigan. The EO rescinds and replaces the previous Executive Order 2020-4 which was issued on March 10, 2020.
Executive Order 2020-34 - Limits non-essential veterinary services on ANIMALS, which would include livestock and farm animals raised for food or fiber. The other change in EO 34 is when a veterinarian performs in-person essential services, the plan must include provisions to minimize the use of personal protective equipment that could be used for human care as much as possible. All other provisions remain the same as in EO 32.
Executive Order 2020-35 – Provision of K-12 education during the remainder of the 2019-2020 school year; Due to the continued spread of the novel Coronavirus, Governor Gretchen Whitmer has continued EO2020-4 to suspend in-person K-12 instruction for the remainder of the 2019-2020 school year. This applies to all public, nonpublic, and boarding schools within the state, and requires a plan to be put in place for instruction for the rest of the year. This order requires schools to continue to provide or arrange for food distribution for eligible pupils and requires the provision of mental health supports for students impacted by the COVID-19 pandemic. Executive Order 2020-36- This most recent EO reaffirmed Governor Whitmer’s commitment to Michigan workers still deemed essential in EO 2020-21, and orders that an employer will be not able to discharge, discipline, or otherwise retaliate against an employee for staying home when he or she is at particular risk of infecting others with COVID-19. Executive Order 2020-37– Visitation Restrictions; Effective immediately and continuing through May 3, 2020, at 11:59 p.m. all health care facilities, residential care facilities, congregate care facilities and juvenile justice facilities must adhere to specific visitation policies outlined in the full order. For limitations and definitions, find the full list Executive Orders at the top of the page. Executive Order 2020-37 rescinds Executive Order 2020-7.
Executive Order 2020-38-Freedom of Information Act (FOIA); Effective immediately, the EO suspends certain procedures regarding public bodies’ responsibilities in responding to requests for public records. It also states that it is the public policy of this state during the COVID-19 emergency that “public bodies continue to respond to requests for public records as expeditiously as possible and, to the extent practicable, by using electronic means.”
Executive Order 2020-39-EMS; On March 7, 2020, Governor Whitmer issued Executive Order 2020-39. The purpose of this EO is to relax certain licensing and regulation requirements for emergency medical services and providers as continuously increased staff and efficiency is needed during the COVID-19 pandemic.
Executive Order 2020-40- Motor Carrier Fuel Tax Licensure Waiver; On April 8, 2020, Governor Whitmer issued Executive Order 2020-40, which provides relief from credentialing requirements for commercial motor carriers under the Motor Carrier Fuel Tax Act (MCTFA) and the International Fuel Tax Act (IFTA).
Executive Order 2020-41- To mitigate the spread of COVID-19, it is crucial all Michiganders limit in-person contact to the fullest extent possible. EO-41 temporarily suspends certain regulations to allow the use of an electronic signature for transactions and business purposes as well as temporarily suspending the requirement of a notary’s physical presence or of any required witnesses. Executive Order 2020-42- Due to the spread of the COVID-19 pandemic within Michigan, EO-42 extends to the 30th of April the temporary requirement to suspend activities that are not necessary to sustain or protect life, rescinding EO-21.EO 42 has been rescinded with the issuance of EO 59. This order is rescinded by EO 59.
Executive Order 2020-43-Due to the widespread of the COVID-19 pandemic within Michigan, EO-43 extends to the 30th of April the closure of places of public accommodation as previously laid out in EO-20. This order does not change the previous allowances for take-out, delivery, window, walk-up, drive-up, or drive-through services but requires special precautions in doing so to mitigate the spread of COVID-19. This order is rescinded by EO 69.
Executive Order 2020-44-In order to extend the relief for suppliers, EO-44 suspends all state and local
seasonal load restrictions as well as noise and timing restrictions for deliveries that meet
immediate needs for COVID-19 efforts. EO-12 is rescinded by this order, which continues through May 11, 2020.
Executive Order 2020-45-EO-23 provided limited and temporary relief from certain rules and procedures commonly done in person. This order extends the duration of that relief, because it remains reasonable and necessary to suppress the spread of COVID-19 and protect the public health and safety of this state and its residents. This order is in place until the 11th of May.
Executive Order 2020-46 – Restaurant Supply Buyback; Allows the Michigan Liquor Control Commission
to issue cash advances to certain on-premises licensees. Executive Order 2020-43 halts most onpremises liquor sales throughout the State of Michigan.
Executive Order 2020-47 which temporarily extends the validity of Michigan-issued operator and
chauffeur licenses, state identifications, and vehicle registrations. This order is rescinded by EO 78.
Executive Order 2020-48, which provides temporary authorization allowing remote participation for local
government public meetings and hearings. It also provides temporary relief from statutory required
monthly school board meetings. EO 2020-48 rescinds EO 2020-15 that was previous in place that
provided the same authorization. This order is rescinded by EO 76.
Executive Order 2020-49 waives requirements for Certificate of Need and reduces requirements for
licensure and care provision. These provisions aim to ensure that medical facilities are open or allowed
to expand as needed and that medical workers are not restricted from providing care due to failure to
meet the technical requirements of their license.
Executive Order 2020-50 – Long-Term Care; Effective immediately through May 13, the executive order
establishes procedures for long-term care facilities pertaining to the health and safety of both residents
and employees. Specifically, the order temporarily prohibits the removal of residents from long-term care
facilities, provides protections for residents and facility employees, and outlines isolation and transfer
protocols for medically stable and unstable residents displaying symptoms of COIVD-19.
Executive Order 2020-51 – Child Care; provides temporary and limited relief from certain regulatory
restrictions regarding child care services, and facilitates the use of certain property for those services to
expand child care access during the COVID-19 emergency. Specifically, the order expedites provisional
licensing of child care facilities, and allows schools and employers to provide unlicensed emergency child
care services provided that they follow rules and guidance set by LARA.
Executive Order 2020-52 – Pesticide Applicator License Extension; On April 17, 2020 Governor Whitmer issued to provide relief for licensed pesticide applicators whose licenses expired at the end of 2019, by extending validity of their licenses until 60 days after the termination of the state emergency. That date would be June 29, 2020.
Executive Order 2020-53 – Price Gouging; is a rescission and revision of EO 2020-18 which also dealt
with price gouging. It puts restrictions in place as it relates to the excessive pricing of goods, materials,
emergency supplies, and consumer food items. These restrictions are in place until May 15, 2020 (the
original EO was in effect until April 17) at 11:59 pm.
Executive Order 2020-54 – Foreclosure suspension; suspends foreclosure and eviction proceedings under
the Revised Judicature Act.
Executive Order 2020-55 – Michigan Coronavirus Task Force on Racial Disparities The EO includes specific procedure related to the operations and implementation of the Task Force. For example, the Task Force may establish advisory workgroups, make “inquiries, studies, and investigations, hold hearings, and receive comments from the public,” or consult with outside experts. The EO provides that all departments, agencies, committees, commissioners, and officers of this state must give any necessary assistance required by the Task Force, and that access also must be given to any books, records, or documents related to matters within the scope of the Task Force’s responsibility, consistent with applicable law.
The Task Force will continue its work until 90 days after the end of the emergency declaration.
Executive Order 2020-56 – Pharmacists; Effective immediately and through May 19 at 11:59 p.m., EO 56
provides for a variety of efficiencies for Pharmacists and Pharmacies, and includes provisions for health insurers
and drug wholesalers.
Executive Order 2020-57 – Unemployment Benefits; Effective Immediately this executive order reaffirms
Executive Order 2020-24 that expanded unemployment benefits and further expands who is eligible for benefits.
Executive Order 2020-57 expands on the existing workshare program to encourage employers to retain
employees and provides coverage to individuals that were offered a new position, but the offer was revoked as
a result of the state of emergency declaration. Additionally, the executive order would allow certain retirees to return to work for UIA or MIOSHA without risking their pension benefits.
Executive Order 2020-58 – Extending Deadlines in Civil and Probate Matters; Consistent with Michigan
Supreme Court Administrative Order 2020-3, the EO suspends and extends, for the duration of the emergency
declaration, all deadlines and related to timing requirements applicable to commencing a civil or probate action and proceeding, including but not limited to, any deadline for the filing of an initial pleading or complaint and the filing of any responsive pleading (i.e. a motion raising a defense or an objection to an initial pleading). Under the EO, any day that falls during the emergency declaration would not be counted for purposes of determining a filing deadline or other timing requirement.
Executive Order 2020-59 - Stay Home, Stay Safe; On April 24, 2020 Governor Whitmer issued Executive Order 2020-59 which updates and extends Michigan’s “Stay-at-Home” order until May 15, 2020. Outlined in the information below are the changes from EO 42 to EO 59 regarding “Stay-at-Home.” EO 42 has been rescinded with the issuance of EO 59. The significant updates to Michigan’s “Stay-at-Home” order are available by following the link above. This order is rescinded by EO-70.
Executive Order 2020-60 - Temporary safety measures for food-selling establishments and pharmacies and temporary relief from requirements applicable to the renewal of licenses for the food-service industry.
Executive Order 2020-61- Temporary relief from certain restrictions and requirements governing the provision of medical services - Rescission of Executive Order 2020-30.
Executive Order 2020-62 - Temporary COVID-19 protocols for entry into MDOC facilities and transfers to and from Department custody; temporary recommended COVID-19 protocols and enhanced early-release authorization for county jails, local lockups, and juvenile detention centers - Rescission of Executive Order 2020-29.
Executive Order 2020-63 - Temporarily suspending the expiration of personal protection orders.
Executive Order 2020-64 – Anti-discrimination in health care; Effective immediately, the EO affirms antidiscrimination policies and establishes procedures that ensure the equitable allocation of medical
resources.
Executive Order 2020-65 School Closure; provides guidance to school districts, parents and students to
continue the learning process while school buildings remain closed due to the coronavirus health
emergency.
Executive Order 2020-66 Termination of the states of emergency and disaster declared under the Emergency Management Act in Executive Order 2020-33
Executive Order 2020-67– Declaration of state of emergency under the Emergency Powers of the Governor Act, 1945 PA 302
Executive Order 2020-68– Declaration of states of emergency and disaster under the Emergency Management Act, 1976 PA 390 through May 28, 2020.
Executive Order 2020-69 – Temporary Restrictions on the use of places of public accommodation Rescission of Executive Order 2020-43
Executive Order 2020-70 – Stay Home, Stay Safe; On May 1, 2020 Governor Whitmer issued Executive
Order 2020-70 which updates and Michigan’s “Stay-at-Home” order. This order is rescinded by EO 77.
Executive Order 2020-71 – Temporary safety measures for food-selling establishments and pharmacies and temporary relief from requirements applicable to the renewal of licenses for the food-service industry. Rescission of Executive Order 2020-60.
Executive Order 2020-72 – Visitation Restrictions; Effective immediately and continuing through May 31,
2020, at 11:59 p.m. all health care facilities, residential care facilities, congregate care facilities and juvenile
justice facilities must follow the visitation guidelines in the EO.
Executive Order 2020-73 - Motor Carrier Fuel Tax Licensure Waiver; On May 5, 2020, Governor Whitmer
issued Executive Order 2020-73, which provides relief from credentialing requirements for commercial motor
carriers under the Motor Carrier Fuel Tax Act (MCTFA) and the International Fuel Tax Act (IFTA). This relief is
only for motor carriers transporting essential items or personnel.
Executive Order 2020-74 - Electronic Signatures, Remote Notarization & Remote Witnessing; is a reissue of 2020-41, which suspends rules and procedures to allow for the use of various electronic records and
electronic signatures when notarization is required for certain records.
Executive Order 2020-75 - Open Meetings Act; Governor Whitmer previous issued Executive Orders 2020-
15 and 2020-48, which provides temporary authorization allowing remote participation for local government
public meetings and hearings. It also provides temporary relief from statutory required monthly school board
meetings. EO 2020-75 rescinds EO 2020-48 that was previous in place that provided the same authorization.
Executive Order 2020-76 – Unemployment Benefits; Effective immediately this executive order reaffirm previous executive orders that expanded unemployment benefits. Previous executive orders have expanded
on the existing workshare program to encourage employers to retain employees and prevented an employer from being charge for unemployment resulting from the COVID-19 virus and associated executive orders.
Additionally, EO 2020-76 removes the “requalification” requirements for an individual that was previously
determined to be disqualified for UIA benefits.
Executive Order 2020-77 - Stay Home. Stay Safe; On May 7, 2020 Governor Whitmer issued Executive Order
2020-77, which updates and extends Michigan’s “Stay-at-Home” order until May 28, 2020 at 11:59pm. EO 70
has been rescinded with the issuance of EO 77.
Executive Order 2020-78 - Extending Licenses and Registration; On May 8, 2020 Governor Whitmer
issued Executive Order 2020-78 extending the validity of Michigan-issued operator and chauffeur licenses,
state identification cards, and vehicle registrations. With the issuance of EO 78, EO 47 is rescinded.
Executive Order 2020-79 – Youth Work Permit –allows for applications for youth work permits to be submitted
and approved by alternative means including by mail, email, fax or online web form. Current law requires
applications for permits to be made in-person.
Executive Order 2020-80 - Administrative Procedures – On May 11, 2020, Governor Whitmer issued
Executive Order (EO) 2020-80 which enhances authorization of remote means for carrying out state
administrative procedures for the Michigan Employment Relations Commission (MERC), the Unemployment
Insurance Agency (UIA), and hearings held under the Administrative Procedures Act of 1969. This is an
extension of EO-2020-23 and EO-45 that were issued previously. EO-80 rescinds EO-45 and is in effect until
June 8, 2020 at 11:59pm.
Executive Order 2020-81 - Truck Regulation – On May 11, 2020, Governor Whitmer issued Executive Order
2020-81, extending relief on noise and timing restrictions for essential deliveries until May 25, 2020 at
11:59pm. Additionally, the EO ensures all state and local road agencies are expediting permits for trucks
carrying essential supplies that exceed non-seasonal weight restrictions. With the issuance of EO 81, EO 44 is
rescinded.
Executive Order 2020-82– Hospital Capacity – effective immediately and continuing through June 9, 2020, at
11:59 pm, MDHHS is authorized to issue an emergency certificate of need to an applicant for additional beds,
and or equipment that will assist in providing health services. This provision also differs certain procedural
requirements of the public health code until the state of emergency is terminated.
Executive Order 2020-83 – Child Care – On May 13, 2020, Governor Whitmer issued Executive Order (EO)
2020-83 which provides temporary and limited relief from certain regulatory restrictions regarding child care
services, and facilitates the use of certain property for those services to expand child care access during the
COVID-19 emergency. Specifically, the order expedites provisional licensing of child care facilities, and allows
schools and employers to provide unlicensed emergency child care services provided that they follow rules
and guidance set by LARA. This is an extension of EO 2020-51 that was issued previously. EO-83 rescinds
EO-51 and is in effect through June 10, 2020.
Executive Order 2020-84 - Long-Term Care - On May 13, 2020, Governor Whitmer issued Executive Order
(EO) 2020-84 which establishes procedures for long-term care facilities pertaining to the health and safety of
both residents and employees. Specifically, the order temporarily prohibits the removal of residents from longterm care facilities, provides protections for residents and facility employees, and outlines isolation and transfer
protocols for medically stable and unstable residents displaying symptoms of COVID-19. This is an extension
of EO 2020-50 that was issued previously. EO-84 rescinds EO-50 and is in effect through May 20, 2020.
Executive Order 2020-85 – Foreclosure Suspensions; Effective immediately and until June 11, 2020, at
11:59 pm the executive order suspends foreclosure and eviction proceedings under the Revised Judicature Act.
Additionally, the executive order prevents any individual from interfering with another person’s lawful possession
of the property unless that possession creates a substantial risk to another person or imminent and severe risk to the property. This executive order does not change an individual’s responsibility to make payments under the
terms of a contract. The time restraints on the courts for foreclosure proceedings under the Revised Judicature
Act are suspended until 30 days after foreclosure proceedings are allowed to continue as usual.
Executive Order 2020-86 – Telehealth; On May 14, Governor Whitmer issued Executive Order 2020-86. This
order encourages the use of telehealth services in the State of Michigan until the COVID-19 health emergency
is no longer effective.
Executive Order 2020-87 - Local Property Taxes – On May 14, 2020 Governor Whitmer issued Executive
Order-87 which extends the deadlines for the Board of Review, County Equalization, and Tax Tribunal
Jurisdiction. EO-87 suspends compliance MCL 211.30 and 211.30a of the General Property Tax Act for Board of Review.
Executive Order 2020-88 - Return to School Advisory Council - creates a 25-person council to advise the
Governor on the “safe, equitable, and efficient K-12 return to school in the Fall”. The council members are
appointed by the Governor and will represent the wide variety of education stakeholders including students,
parents, teachers and administrators.
Executive Order 2020-89 - Price Gouging - is a rescission of EO 2020-53 which also dealt with
price gouging. It puts restrictions in place as it relates to the excessive pricing of goods, materials, emergency
supplies, and consumer food items. These restrictions are in place until June 12, 2020 (the original EO was in
effect until May 15) at 11:59 pm.
Executive Order 2020-90 - Research Laboratories – On May 15, Governor Whitmer issued Executive Order
2020-90, which allows research laboratories to resume their operations. EO 2020-90 lays out the following
protocols research laboratories, but not laboratories that perform diagnostic testing, must adhere to in addition
to the workplace safeguards described in subsection 11(a) through (h) in Executive Order 2020-77...
Executive Order 2020-91 Provided safeguards to protect Michigan's workers from COVID-19. This order is rescinded by EO 97.
Executive Order 2020-92 Provides temporary requirement to suspend certain activities that are not necessary to sustain or protect life. This order is rescinded by EO 96.
Executive Order 2020-93 Effective immediately and through June 16th at 11:59 p.m., EO 93 provides for a variety of efficiencies for Pharmacists and Pharmacies, and includes provisions for health insurers
and drug. Provides temporary enhancements to operate capacity, flexibility, and efficiency of pharmacies.
Executive Order 2020-94 Not COVID-19 related, declares state of emergency for Midland.
Executive Order 2020-95 Provides enhanced protections for residents and staff of long-term care facilities during the COVID-19 pandemic.
Executive Order 2020-96 Allows the temporary requirement to suspend certain activities that are not necessary to sustain or protect life. This allows retail businesses and auto dealerships to reopen with restrictions, on Tuesday, May 26, as part of her MI Safe Start plan. The governor’s executive order also lifts the requirement that health care providers delay some nonessential medical, dental, and veterinary procedures statewide beginning on Friday, May 29. And the order authorizes small gatherings of 10 people or less starting immediately, as long as participants practice social distancing. Rescission of Executive Orders 2020-17, 2020-34, and 2020-92.
Executive Order 2020-97 Introduced safeguards to protect Michigan's workers from COVID-19. Per the amended order, reopened outpatient health-care facilities, including clinics, primary care physician offices, and dental offices will have to adopt strict protocols to prevent infection. The Department of Licensing and Regulatory Affairs will issue guidance to aid those facilities in adopting appropriate safeguards.
Executive Order 2020-98 - Declaration of Emergency Extension; extends the state of emergency that was
declared under the Emergency Powers of the Governor Act of 1945 until June 19, 2020 at 11:59 pm. It
rescinds EO 2020-67 and EO 2020-68 which were the previous state of emergency orders under both the
1945 Act and the 1976 Emergency Management Act. Those Executive Orders were to expire on May 28 at
11:59 pm. All previous orders that rested on EO 2020-67 and 2020-68 now rest on this order.
Executive Order 2020-99- Not COVID-19 related On May 19, 2020, Governor Whitmer issued Executive Order 2020-94 declaring a state of emergency for the city of Midland and the county of Midland due to severe flooding. EO 99 amends and expands Executive Order 2020-94.
Executive Order 100 - Executive Order Extensions and Clarifications –On May 22, 2020, Governor Whitmer
issued Executive Order 2020-100, which clarifies and extends the duration of various EO’s.
Executive Order 2020-101 - Watercraft Registration Extension – On May 22, 2020 Governor Whitmer signed
Executive Order 2020-101, extending the validity of watercraft registrations that expired after February 1, 2020 to July 31, 2020. Similar to an earlier Executive Order extending the validity of expired vehicle registrations and drivers licenses, this order extends until July 31, 2020 any watercraft registration that has expired since February 1st. This will reduce the need for in-person interactions at Secretary of State branch offices.
Executive Order 2020-102 - Motor Fuel Blend Extension – On May 22, 2020 Governor Whitmer issued
Executive Order 2020-102, which extends the temporary suspension of Michigan’s Reid Vapor Pressure
standards and permits the transportation and sale of gasoline with a higher Reid vapor pressure across the state. In simple terms, this extends the date allowing for the continued sale of “winter blend” gasoline, and postpones the requirement of using the more expensive, but more environmentally friendly “summer blend”.
Executive Order 2020-103 - Tax Abatement Hearings – On May 22, 2020 Governor Whitmer issued
Executive Order 2020-103, which allows any public hearing required under a tax abatement statute to be held
electronically. Public electronic tax abatement hearings that may be held electronically include telephone
conferencing or video conferencing so long as they allow individuals entitled to a tax abatement to participate.
Executive Order 2020-104 - Increases COVID-19 testing by expanding the scope of practice for certain
professionals and encouraging the establishment of community testing locations.
Executive Order 2020-105 - Related to the devastation in Midland County from the dam breaking.
Executive Order 2020-106 -Establishing deadline to redeem property for nonpayment of delinquent property taxes.
Executive Order 2020-107-To ensure Michigan workers can acquire the skills and credentials they need to secure and advance in jobs with family-sustaining wages, and to ensure Michigan’s job providers have access to the skilled workers they need to succeed in a global economy, Michigan must strengthen the quality and labor market relevance of its workforce through investment, education, and economic development efforts. Achieving this requires the alignment of these efforts to support a comprehensive, accessible, and high-quality workforce development system. Therefore this establishes a state workforce development board.
Executive Order 2020-108 - Temporary restrictions on entry into health care facilities , residential care, congregate care facilities, and juvenile justice facilities
Executive Order 2020-109 - Temporary safety measures for food-selling establishments and pharmacies and temporary relief from requirements applicable to the renewal of licenses for the food-service industry
Executive Order 2020-110 - The governor’s order will allow retailers to reopen on June 4 and restaurants to reopen on June 8, both subject to capacity limits. Day camps for children will likewise be permitted to open on June 8. Effective immediately, groups of 100 or less will be allowed gather outdoors with social distancing. Office work that is not capable of being performed remotely can resume. And in-home services, including housecleaning services, can resume operations.
Executive Order 2020-111-Protecting the Food Supply and Migrant and Seasonal Agricultural Workers from the effects of COVID-19.
Executive Order 2020-112- On June 3, 2020, Governor Whitmer signed Executive Order 2020-112 rescinding EOs 39 and 82 and extended EO 38.
Executive Order 2020-113-Enhances authorization of remote means for carrying out state administrative procedures for the Michigan Employment Relations Commission (MERC), the Unemployment Insurance Agency (UIA), and hearings held under the Administrative Procedures Act of 1969.
Executive Order 2020-114-Workplace Safety; EO 2020-114 rescinds and replaces EO 2020-97 that provides workplace safety standards for the various types of businesses and industries as they re-open.
Executive Order 2020-115-Temporary restrictions on certain events, gatherings, and businesses.
Executive Order 2020-116-Temporary suspension of youth work permit application requirements. It is an extension of EO 2020-79 which allows for applications
for youth work permits to be submitted and approved by alternative means. The EO is in effect until July 3.
Executive Order 2020-117- Provides temporary and limited relief from certain regulatory restrictions regarding child care services, and facilitates the use of certain property for those services to expand child care access during the
COVID-19 emergency. Specifically, the order expedites provisional licensing of child care facilities, and allows schools and employers to provide unlicensed emergency child care services provided that they follow rules and
guidance set by LARA. This is an extension of EO 2020-83 that was issued previously. EO-117 rescinds EO-83 and is in effect through July 7, 2020.
Executive Order 2020-118- Foreclosure Suspensions; – Effective immediately and until June 30, 2020, at 11:59 pm the executive order replaces EO 2020-85 by suspending residential foreclosure and eviction proceedings under the Revised Judicature Act.
Executive Order 2020-119-MDOC & County Jails; is a re-issue of 2020-62, which requires the Michigan Department of Corrections to implement risk reduction protocols, suspends strict compliance with the capacity and procedural requirements regarding county jail overcrowding, and strongly encourages early release of prisoners who do not present a safety risk.
Executive Order 2020-120-Summer Camps; Under Executive Order 2020-120, travel, residential, and troop camps are allowed statewide beginning on June 15, 2020 at 12:01am. Additionally, the EO permits limited school sports activities and in-person extracurricular school activities. For regions 6 & 8 all indoor and outdoor school activities are permitted. For the rest of the state, outdoor school actives are permitted but
indoor activities are not.
Executive Order 2020-121 - MCOLS; expands the Michigan Commission on Law Enforcement Standards to include the following additional members:
• The Director of the Michigan Department of Civil Rights; and,
• Three residents of this state appointed by the Governor with the advice and consent of the Senate.
Under the EO, a member must not be a law enforcement officer or otherwise affiliated with a law enforcement agency or a law enforcement training academy.
Executive Order 2020-122-Ending the Extension of Case Deadlines; Effective June 20, 2020, Executive Order 2020-122 rescinds Executive Order 2020-58, which suspended and extended all deadlines (or statute of limitations) applicable to commencing a civil or probate action and proceeding. Under the EO, all applicable deadlines are tolled from March 10, 2020 to June 19, 2020.

Executive Order 2020-142 - Provision of PreK–12 education for the 2020–2021 school year. EO 42 requires schools to adopt a COVID-19 Response and Preparedness Plan.
Executive Order 2020-143 - Closing indoor service at bars.
Executive Order 2020-144- A public water supply must restore water service to any occupied residence where water service has been shut off due to non-payment, so long as the public water supply does not have reason to believe that reconnection would create a risk to public health.
Executive Order 2020-145- Outlines workplace safety guidelines for meatpacking plants to keep employees safe.
Executive Order 2020-146- Extends protections for vulnerable populations in Michigan’s county jails, local lockups and juvenile detention centers through Aug. 6, 2020.
Executive Order 2020-147- Reiterates that individuals are required to wear a face covering whenever they are in an indoor public space. It also requires the use of face coverings in crowded outdoor spaces. The order requires any business that is open to the public to refuse entry or service to people who refuse to wear a face covering, with limited exceptions.
Executive Order 2020-148- Maintains the strong infection control protocols in nursing homes the governor put in place at the outset of this crisis, and protects residents from eviction and employees from discriminatory action for staying home when exhibiting symptoms. Under the order, a long-term care facility is required to take specific precautions when a resident exhibits symptoms of COVID-19 — including informing employees of the facility.
Executive Order 2020-149- Extends existing safety measures, including 2 hours a week of reserved shopping time for vulnerable populations, to protect consumers and employees at grocery stores and pharmacies.
Executive Order 2020-150- This EO scales back the suspension of scope of practice laws for frontline health care workers while continuing suspension of certain licensing and certification requirements for health care professionals, life support and first aid workers, and 911 operators. EO-150 rescinds EO-61.
Executive Order 2020-151-Declaration of state of emergency and state of disaster related to the COVID-19 pandemic.
Executive Order 2020-152-Training of pharmacists.
Executive Order 2020-153- Masks required for anyone who leaves their place of residence, including when in any indoor public space, when outdoors and unable to consistently maintain a distance of six feet or more from individuals who are not members of their household, and when waiting for or riding on public transportation, while in a taxi or ride-sharing vehicle, or when using a private car service as a means of hired transportation. This is a rescission of Executive Order 2020-147.
Executive Order 2020-154- Alternative means to conduct government business during the COVID-19 pandemic.
Executive Order 2020-155-Implementation of expenditure reductions under Section 20 of Article 5 of the Michigan Constitution of 1963.
Executive Order 2020-156-Temporary restrictions on entry into health care facilities, residential care facilities, congregate care facilities, and juvenile justice facilities. Rescission of Executive Order 2020-136.
Executive Order 2020-157-Temporary suspension of youth work permit application requirements. Rescission of Executive Order 2020-140.
Executive Order 2020-158-Encouraging the use of electronic signatures and remote notarization, witnessing, and visitation during the COVID-19 pandemic. Rescission of Executive Order 2020-131.
Executive Order 2020-159- Amending the fire code to accommodate new instruction spaces. To enable students to remain physically separate from one another while attending class, many colleges and universities wish to convert large spaces previously used for other purposes into classrooms. Under current rules, however, each conversion requires inspection and approval by the Bureau of Fire Services. To facilitate swift conversions, this order relieves colleges and universities of the need to secure approval before using an existing space for instruction.
Executive Order 2020-160- Amended Safe Start Order. This EO limits statewide indoor gatherings to 10 people or less and, across most of the state, limits outdoor gatherings to 100. It also orders that bars in every region, including those in regions 6 and 8, must close for indoor service if they earn more than 70% of their gross receipts from sales of alcoholic beverages. Rescinds Executive Orders 2020-110, 2020-115, 2020-120, 2020-133, and 2020-143.
Executive Order 2020-161-Issues revised workplace safeguards.
Executive Order 2020-162-Amendment to Executive Order 2020-160. The restriction described in section 1 of Executive Order 2020-160 does not apply in Regions 6 and 8. Instead, in Regions 6 and 8, any work that is capable of being performed remotely (i.e., without the worker leaving his or her home or place of residence) should be performed remotely.
Executive Order 2020-163- Establishment of the Black Leadership Advisory Council. The Black Leadership Advisory Council (“Council”) is created as an advisory body within the Department of Labor and Economic Opportunity (“Department”).
